Deputy director of public prosecutions Alexander Muteti has made a formal application asking the recusal of senator James Orengo from KPA's Managing director Daniel Hezron Manduku citing conflict of interest.

A ruling that was to be delivered today on whether Manduku should be arrested or not has been deferred until the matter has been resolved.

An argument is underway at the Mombasa High Court. Manduku has gone to court to seek an anticipatory bond to stop the police from arresting him.

According to Muteti, DPP Noordin Haji claims Senator James Orengo as one of the people with an interest in the case where more of his relatives are directly affiliated.

The Senator refused to accept the conflict of interest citing witch hunt from the prosecutor.
