Senators and former MPs are vehemently opposing the new document while agreeing on a smaller part. 


Former MP Kabando wa Kabando, Senator Kipchumba Murkomen, Former MP Martha Karua, Senator Ole Kina among others are criticising the BBI document on several instances that will break the country governmental structure.


Judiciary


According to Elgeyo Marakwet Senator Kipchumba Murkomen and the Law Society Boss Nelson Havi, the Judiciary needs to remain independent.


"The Judiciary Ombudsman must however not be a conduit for the proposed Imperial President to control the Judiciary through the back door. The best way is to have an ombudsman appointed by and reporting to the Judicial Service Commission, " Murkomen says.



" I have this morning confirmed that the office of Deputy President remains unchanged in the BBI Constitutional amendment proposals, which herald the return of the imperial presidency and undermine Independence of Judiciary, " Martha Karua said.


" Judiciary needs to be independent and must not have a sabotage conduit with the executive, " LSK president said.


Prime Minister and Deputy President


The debate on the Prime Minister and the Deputy President has taken another centre stage with tough questions asked.


" Does it mean if you win the presidency but your party/coalition doesn't win the majority in the National Assembly then you appoint a leader of your competing party/coalition as Prime Minister to lead govt business and implement your manifesto?, " BBI followers posted.


Others faulted the document on having a PM with more powers than the Deputy President.


"I think Deputy President need to have more privileges than PM including acting as president when the president is incapacitated, or unavailable. He can also assume the presidency in the event of death or abdication of a president, " Cyrus Maina contributed to the debate.


" So, he campaigns all over the country seeking votes then he sits and hopes for the death or incapacitation of the president, while the PM who is nominated by the president runs the government?" he added.


" So the BBI Constitutional Amendment Proposes that we retain a Deputy President who is the running mate of President and then appoint a PM with Deputies who will enjoy more powers than the donkey (DP) who fought for votes. Someone thinks WSR will be DP forever. This is a recipe for chaos, Senator Murkomen said.
