Justice Weldon Korir declares the Gatundu North parliamentary seat vacant.


Justice Korir ruled that the IEBC should carry on new elections for the seat.


The judge also ordered the Deputy Registrar to deliver the ruling to the speaker of the National Assembly for proper action.

"I declare that the seat of the MP Hon Anne Wanjiku has become vacant," Korir said.


Judge Korir says the election by Hon Wanjiku violated the law.


In the case, former MP Clement Kungu Waibara had gone to court questioning Wanjiku's election.


The case went to the Court of Appeal before directed it to be heard afresh.


The Court of Appeal ordered the case be heard by a constitutional court.


The petitioner told the court that Wanjiku was not qualified to be an MP when she was still a member of a county assembly with a monthly salary and all the other benefits and responsibilities accorded to that position.
