East Africa Court at Arusha directs Kenya Government to pay Martha Karua Sh 2.8 Million

 

 The East African Court of Justice at Arusha directs the government of Kenya to pay Narc-Kenya party leader Martha Karua Sh2.8 million in losses.

 

The court found that through the Supreme Court, the State had declined Ms Karua her right to fair hearing in a concern where she questioned the election of Kirinyaga Governor Ann Waiguru.


Principal Judge Monica Mugenyi, justices Charles Nyawello and Charles Nyachae ruled that it was wrong for the court to terminate Karua's petition on a technicality.


The three-judge bench also settled that the High Court also endured in the way of justice that has taken six months to resolve the suit.

"We have recorded that the High Court resolved the petition after the slip of six months from the date of filing. That was an insult to the Constitution and the enabling electoral laws.


"Sitting as such, the Supreme Court would be the legal organ tasked to provide a just and equitable solution to the distinguished procedural catastrophe, where no time is assigned to the hearing of matters on discharge," the court ruled.
