DPP's request to drop Aisha Jumwa murder charges against Ngumbao Jola granted by hight court

The High Court dismissed the murder case against Aisha Jumwa, who is the cabinet secretary for gender and public service, on Wednesday.

Judge Ann Onginjo of the High Court said that the Chief Justice had nothing more to do with the criminal case.

 Onginjo's ruling stated, "Ms. Jumwa is hereby discharged from the proceedings in consideration of the oral application made by the ODPP in November, followed by a letter from Coast Region Coordinator Hassan Abdi." 

"Based on the ODPP's oral request from November and the letter that followed from Coast Region Coordinator Hassan Abdi."

Ngumbao Jola was killed  in 2019 in Kilifi County,  and Jumwa and  her bodyguard Geoffrey Okuto  were charged with her murder along with Okuto. Jumwa was also accused of the murder of Ngumbao Jola.

The CS is now in a position to testify on behalf of the state in the murder prosecution that is being brought against her bodyguard,  Geoffrey Otieno Okuto.

 
DPP Noordin Haji put in a motion to drop  the murder charge against Jumwa.  She said she would be testifying on behalf of the state.

Danstan Omari, who was Jumwa's lawyer in court, argued that his client should testify for the state because the evidence used to charge her with murder can't support a murder conviction.

The attorney also said that Jumwa does not possess a gun, nor has she ever fired one in her life.

Earlier, the CS sent a letter  to the DPP asking  to be called as  a state witness in a murder case  where the defendant was a suspect.

On October 18, her lawyers asked that the charges against her be dropped. 

They said that the evidence that was given by the three witnesses for the prosecution showed that their client did not shoot Ngumbao.
