A request for a court order to see the CCTV video of former Cabinet Secretary Fred Matiang'i's home in Karen, Nairobi, has been made by the Directorate of Criminal Investigations (DCI).

This is in the context of the police crackdown that allegedly occurred on the residence of the former Interior CS on February 9 at about midnight.

Matiang'i alleges that police personnel searching for him searched, encircled, and roped off his residence.

In a request dated February 10, the investigating authority asks the court to order Amsec Surveillance Services, which is in charge of guarding Dr. Matiangi's residence, to provide security video from the time between 6 a.m. on February 8 and 11 p.m. on February 9.

"That a court order be and is hereby issued compelling the manager of Amsee Security Services Limited (the Respondent), in person or through a nominee, to obtain and make available to the Applicant, through No. 235834 C.1 Eunice Niue, a police officer and an investigator attached to County DCI Headquarters Nairobi (the Applicant), the footages for the time period between 6:00 a.m. on February 8, 2023, and 11:00 a.m. on February 9, 2023. " The previous cabinet secretary for interior and national security, Dr. Fred Matiang'i, is mentioned by DCI.

According to the petition filed with the Nairobi magistrate court, the Nairobi DCI is looking into a case of suspected aggravated burglary in violation of Section 297 of the Penal Code, which is what prompted the filing of the motion in question.

According to the petition filed with the Nairobi magistrate court, the Nairobi DCI is looking into a case of suspected aggravated burglary in violation of Section 297 of the Penal Code, which is what prompted the filing of the motion in question.

Similar to this, the DCI claims that on February 9, 2023, reports of a rumored raid at LR No. 12302/9 inside Karen Ngong View by unidentified individuals who claimed to be police officials surfaced in the morning.

DCI contends likewise that the purported assault was never authorized by the National Police Service and that it became essential to conduct an investigation in order to identify individuals who were engaged.

There is a requirement to collect the CCTV footage for penitentiary reasons since it has been "preliminary proven that the claimed residential Karen Ngong view inside Karen is monitored by CCTV cameras maintained by the respondent," according to court documents.

The DCI further requests that the management be instructed to provide its investigators with a certificate of production of electronic evidence from the CCTV video.

On February 22, the subject will be brought up to determine if the manager has followed the instruction.

The police officers reportedly withdrew only when the media and his attorneys showed up, according to the former CS.

Since then, Interior Cabinet Secretary Prof. Kithure Kindiki has come out to deny the alleged dispatch of police to Matiang'i's residence.

Lawyers for Dr. Matiang'i and a few politicians who talked to the media on the site said that the individuals in question were police officers deployed to detain the former Cabinet Secretary. In a statement released on February 9, Kindiki said, "This claim is completely incorrect."

No police officers or security personnel from any government agency or department were sent to Dr. Matiang'i's residence with the intent to detain him, intimidate him, or in any other way compromise his constitutional rights.

DCI director Mohamed Amin also said that the event was nothing more than a "well-coordinated and planned effort to circulate false information and cause public anxiety" after conducting an independent investigation to ascertain the veracity of Matiang'i's accusations.

After the former CS filed a court motion asserting that he is under the impending threat of arrest by the police and is reasonably concerned that his constitutional rights are being violated, the High Court later granted Matiang'i a Ksh. 200,000 anticipatory bail, prohibiting police from apprehending and locking him up.
