A 55-year-old welder who was charged with burglary was found guilty of five additional crimes and given a 210-year prison sentence by an Eldoret court.
Humphrey Shilisia's co-defendants, including his wife Amina Melisi and David Gazemba, were cleared of charges of robbery with violence because there was no proof.
Eldoret Senior Principal Magistrate Naomi Wairimu decided that the offender will spend 50 years in jail. The sentences will run at the same time.
The three defendants were charged with robbing Gladys Rotich of Ksh6,000 on June 20, 2020, at Wales Estate in Kapseret Sub-County, Uasin Gishu County, while carrying lethal weapons.
Shilisia was also accused of raping Gladys on the same day and in the same place after taking Ksh6,000 from her phone.
The three would also be charged with robbing Yulita Mitei of valuables worth Ksh19,300 in a violent way on the same day.
Also, they were accused of stealing Ksh76,800 from Moses Rotich and trying to hurt him very badly on the same day and in the same place.
The defendants were also convicted of brutally robbing Gilbert Murei of Ksh4,800 on the exact same day and at the same location.
During her testimony against Shilisia, the claimant said that the thieves broke into their home at night while holding a torch.
She said that the first suspect deposited Ksh 6,000 from her phone to her husband's phone before ordering him to crawl beneath the bed.
"He then raped me while holding a panga around my neck and ordering me to leave with him."
The complainant said, "Following the trauma, he requested for vehicle keys, and when I informed him that I did not know how to drive, he allowed me back to the home, slammed the door, and went."
The first accused individual said in his evidence that he got out of bed on July 20, 2020, and left for his welding work and that on the way home, he paused to get some music put on his USB.
He said that two officers from the Langas Police Station stopped him on the way, so he helped them.
The inmate claims that after asking him to accompany them to his home so they could look for a gun, the cops stole a home theatre, a TV, and a gas cylinder before detaining his wife.
In his defence, the second suspect testified before the court that he was accused of robbery with violence because he didn't comply with the interrogating officer's instructions to incriminate someone else.
"Once I refused to accuse another person of the capital crime, I was falsely accused of robbery with violence," according to Gazemba.
The trial magistrate said that it was anything more than a legitimate request that Gladys, the complainant, had been burglarized as claimed when passing judgement on the first accused.
The plaintiff was undoubtedly raped, according to the medical doctor's findings, the magistrate concluded.
