Three Kisii teachers accused of beating, injuring student charged

On Thursday, three instructors who have been charged with assaulting and wounding a secondary school student appeared before the Ogembo Law Courts in Kisii County.


In accordance with Section 234 of the Criminal Code, the three defendants, Douglas Mabiria, Abel Manyange, and Franklin Ongwae, were charged with causing severe bodily injury.


They were brought before the Senior Principal Magistrate of Ogembo, Paul Biwott, for their arraignment.


A pupil in Form 4 at Nyabisia Secondary School has been reported to have lost one of his testicles after being caned so severely by his instructors that they caused him to lose the testicle.


Ian Makotsi, who represents the state, submitted an application in which he voiced his opposition to the decision to release the individuals charged on bail.


The prosecution said that owing to the severe circumstances surrounding the case, it is possible that the suspects, who are teachers, might tamper with the testimony of those who testified if they are granted bail.


Tom Ongori, who is representing the suspects in this case as the defence attorney, contended that there were absolutely solid reasons to refuse bail for the men who were charged.


In his conclusion, the court magistrate concluded that the charged persons were eligible for release based on their merits.


"Taking into consideration the motion to refuse bail to the accused individuals, the present request corroborated the allegation that the charged individuals would attempt to influence the testimony of the witnesses."


The accused educators were freed after posting a bond of 100,000 Kenyan shillings (KES) apiece and a cash bail of 20,000 Kenyan shillings (KES).


On April 27th, the court case will once again be in session for a mention.
