The Director of Public Prosecution (DPP), Noordin Haji, has decided to drop all charges involving six prominent politicians who were being investigated for their roles in organising demonstrations on behalf of the Azimio la Umoja-One Kenya alliance.


So that there would be "harmony between the people who were convicted and the state," the prosecution asked that the six be cleared of the charges.


The six are Ugunja Member of Parliament James Opiyo Wandayi, Kilifi Senator Stewart Madzayo, Kilifi South Member of Parliament Richard Chonga, Malindi Member of Parliament Amina Laura Mnyazi, George Yogo Obure, and Esther Oromi.


"To foster an atmosphere conducive to reconciliation between the convicted individuals and the state, we would like to request that the case be dismissed under Section 87A of the Criminal Code. I strongly recommend that this issue be dropped," according to the DPP.


Boaz Ombewa, a senior principal magistrate at the Kahawa Law Court, let the six people go and said that they should get their money back.


Magistrate Ombewa said, "I have looked at the state's request to drop the charges against the six accused people under Section 87A, and I have decided to dismiss them."


Defence lawyer Dunstan Omari said that the case could not have been maintained since the DPP used a provision that was deemed "non-existent" to prosecute the six defendants.


"The charge sheet that was presented in court would not be upheld. Our deliberations have led us to the conclusion that Parliament needs to act with haste and highlight the provision so that the state does not find itself in an awkward position by relying on something that does not exist. The state should make progress on legal reform, "Omari remarked.


The six were accused of conducting an illegal assembly as well as vandalising a VW Passat that belonged to Joyce Nyambura and had a value of Ksh1.1 million.
