Since there was inadequate proof, the Office of the Directorate of Public Prosecutions has instructed the Directorate of Criminal Investigations to terminate the inquiry file on former Interior Cabinet Secretary Fred Matiangi and lawyer Danstan Omari.


The ODPP said on Monday that the proof that was presented did not satisfy the requirements necessary to substantiate the allegations of criminal and cybercrime charges levelled against the former head of security.


The DPP says that Matiangi and Omari shouldn't have to deal with any more punishment from the police.


"Following an independent and complete study of the explanation offered and a consideration of the testimonies of the witnesses, the Director of Public Prosecutions concluded that the information produced was not adequate to support the aforementioned charges against Dr. Fred Okeng'o Matiang'i and his lawyer, Mr. Danstan Omari," Lilian Obuo, the Deputy Director of Public Prosecutions and Head of Staff, said in her statement.


On March 7, the Directorate of Criminal Investigation (DCI) conveyed an inquiry file to the Directorate of Public Prosecution (DPP) for review and advice regarding the charges against Matiangi, which include conspiracy to commit a felony in response to allegations of a raid at Matiangi's Karen home and publicising wrong information with the intention of causing panic.


The criminal charge against him said, "Between February 8 and 9, 2023, at Karen Ngong View Estate in Nairobi County, Republic of Kenya, with the intent to cause fear, confusion, or mayhem among the people of the Republic of Kenya, together with another person who told the media that his home had been stormed by a battalion and or Garrison of Police officers who wanted to arrest you, which you knew was not true."
