International Economist David Ndii and four others move to court to confront the President Uhuru Kenyatta and ODM chief Raila Odinga led Building Bridges Initiative (BBI) reforms.
David Ndii, Jerotich Seii, James Ngondi, Wanjiku Gikonyo and Ikal Angelei, filed a petition through Law Society of Kenya President Nelson Havi, questioning the progress to revise the 2010 Constitution.
On September 16, Ndii stated that they would challenge the boundaries of Constitutional amendments and other clauses within the Kenyan laws.
“Yes @JerotichSeii, @Ikal_Angelei, @CiruGikonyo, @JamesGondi and myself have today filed a petition on the applicability of the theory of the basic structure of the Constitution, the doctrine of unconstitutional Constitutional amendments, eternity clauses and limits of the constitutional amendment, ” Ndii posted.
” The fourfold want the case to be certified as primary and be heard by a bench of not less than three judges appointed by Chief Justice David Maraga who is also the president of the Supreme Court, ” he added.
“The petitioners named the Independent Electoral and Boundaries Commission (IEBC), National Assembly Speaker Justin Muturi, his Senate counterpart Ken Lusaka, and Attorney General Paul Kihara as respondents in the case, ” he stated.
The BBI taskforce was installed following the famous Uhuru and Raila handshake in March 2018.
The task-force was mandated to come up with suggestions on ways to adapt existing institutions so that important matters are addressed inclusively.
Since then, BBI has earned tepid backing from the majority of Kenyans. It has also been questioned by some people in and out of power.
