Joseph Ngaruiya, 40, claimed to have undergone difficulty in breathing while with his girlfriend at Myra apartments in Kilimani on Monday, February 28.
On a disastrous day, Joseph went to the apartment found along Kindaruma Road before the 25-year-old woman, only recognized as gym fanatic JM.
Minutes later, the girlfriend, who is reportedly a Kenya Revenue Authority employee, rushed out of the apartment, screaming, saying her lover had collapsed and died.
Police raced to the scene with paramedics who testified that he had died. They moved the body to the mortuary pending an autopsy.
In the application filed in court on Wednesday, March 2, JM, upon interrogation, acknowledged that they checked in the apartment at 6 pm.
She said while they were making love, he began generating whizzing sounds before getting off the bed. He then sat on the floor while gasping for air.

The woman told the police that she attempted to ask the deceased what was transpiring but he never reacted, which urged her to tempt the intervention of the apartment management.
By the time emergency assistance arrived, he had already succumbed.
