Gonga Hapo! Couple arrested for disturbing neighbours

Two teenagers were arrested in Vihiga for allegedly disturbing neighbours at night while making love. The neighbours say they’ve always been distracted, and at times they think it’s violence.

“Saa zingne tunasikiza kill me, finish me, nimalize kabisa, gonga hapo, ndani kabisa, inabidi tutoke tuone nani anauliwa” a neighbor was heard saying.

In many jurisdictions, excessive noise that disturbs the peace is considered a public nuisance.

The teenagers’ actions, if they indeed were causing significant disturbances, could legally be seen as violating noise regulations, especially if this happened late at night.

While personal activities within one’s private space are generally protected, the loudness of the situation suggests a breach of public decency or privacy norms, where private actions become public disturbances.

The comments from the neighbours reflect not only the disturbance but also a perceived sense of urgency or concern for safety, mistaking the sounds for violence.

This indicates a community’s threshold for acceptable behaviour and noise, particularly at night.
