On matters of BBI Appeal, the submissions of lawyer Elias Mutuma on behalf of ThirdWay Alliance have deconstructed all the effort made by SC James Orengo and SC Otiende Omollo.
” A popular initiative can only be enacted by the people, proposed to IEBC by the people and approved as a referendum by the people. The executive and parliament have not been given legislative authority thus cannot initiate or legislate under Article 257, ” the Elite lawyer Elias Mutuma said.
“The initiative is said to be promoted by Dennis Waweru and Junet Mohamed, that is taking us for a ride. Though the handshake was packaged as an initiative to promote unity and cohesion, it was a Trojan horse to use executive powers to amend the constitution, ” he added.
“If we are to go with the assertions of the appellants, this was drafted by Dennis Waweru and Junet Mohamed so it shouldn’t be a problem for the people to enact a law. Subsequently, we will show that the Executive was involved all along,” added Lawyer Elias Mutuma.
The lawyer continued, “The appellants are telling us that the BBI National Secretariat is a business entity owned by Junet Mohamed and Dennis Waweru.”
“If we are to go with the assertions of the appellants, this was drafted by Deno Waweru and Junet so it shouldn’t be a problem for the people to enact a law. Subsequently, we will show that the Executive was involved all along, ” the layer explained.
