Tana River MCA Babusa Hamid Salim charged with tax fraud amounting to millions

The Kinakomba Ward MCA, Babusa Hamid Salim, has been called by the Mombasa Law Court to face accusations of tax fraud. 

Darweish Constructors Limited, owned by Babusa Hamid Salim, is facing six charges of tax fraud and nonpayment of income and value-added taxes totaling KSh 8,697,748. This is notwithstanding the fact that the firm allegedly raked in KSh 21 million from goods sold to the County Government of Tana River. 

Kinakomba MCA charged for tax fraud

Failure to pay KSh 491,379 in 2020, KSh 3,631,113 in 2021, and KSh 1,565,976 in 2022 in accordance with Section 95 of Section 104(1) of the Tax Procedures Act is one of the offences. 

Fraud involving taxes by not reporting KSh 237,500 in 2020, KSh 1,936,593 in 2021, and KSh 835,187 in 2022, in violation of Sections 97 (a) and 104 (3) of the Tax Procedures Act, is another crime. 

On April 18, 2024, the person being charged will appear before Hon. David Odhiambo, the Principal Magistrate. 

The directors of Bendegwa Limited were previously accused of failing to pay KSh 3,769,984 after dealing with the County Government of Tana River, making this the second instance of tax fraud to be identified by the Kenya Revenue Authority. 

On various days between January 1, 2017, and August 31, 2023, Bendegwa Limited provided the County Government of Tana River with commodities valued at KSh 8,339,400. 

Imani Sango Mponoa and Vilimine Nababe Moses, both of whom are directors of the firm, have also been summoned to appear before Mombasa Senior Resident Magistrate Rita Orora on April 15, 2024.
