Courts declines to stop MPs from impeaching DP Gachagua

For the second time, the High Court has declined to grant orders stopping the impeachment proceedings against Deputy President Rigathi Gachagua.

On Monday, Justice Bahati Mwamuye heard the matter and directed that the Presiding Judge of the High Court, Chacha Mwita, receive it for further instructions.

Meanwhile, the National Assembly has requested that all cases challenging the impeachment process be combined.

They argue that merging the cases, which involve similar issues, would enable the Court to examine them more quickly and efficiently.

“There are thirteen (13) petitions so far before the High Court in Nairobi and other stations across the country, all challenging H.E. Rigathi Gachagua’s removal by impeachment as the Deputy President of the Republic of Kenya,” according to the application.

On September 30, the court declined to issue orders stopping Parliament from processing an impeachment motion against Deputy President Rigathi Gachagua.

Ex-UDA Secretary General Cleophas Malala filed a motion to prevent the National Assembly and the Senate from tabling, debating, considering, or acting upon any motion to remove DP Gachagua.

Malala argued that both Houses lack the required two-thirds gender rule threshold and therefore have breached the constitutional provisions.
