The Director of Public Prosecutions (DPP), Renson Igonga, has declined a request from the Directorate of Criminal Investigations (DCI) to charge social media influencer Kevin Moinde, citing insufficient evidence.
Moinde was detained following allegations of posting malicious content targeting Deputy Inspector General (DIG) Eliud Lagat.
The DCI had forwarded the investigation file to the DPP for review, seeking approval to press charges.
In a statement issued on Monday, DPP Igonga confirmed that after a thorough review of the case file, the evidence presented did not meet the threshold required for prosecution.
“The file lacked sufficient grounds to sustain charges against Mr Moinde,” Igonga said.
Moinde’s detention had sparked debate online, with some users defending his right to free expression while others condemned the alleged defamatory posts.

The police claim Ojwang died by suicide after injuring himself in his cell, a narrative disputed by family and activists who allege torture, citing visible injuries including a swollen head and blood from his nose and mouth.
