The Cop who killed Yassin Juma get a big blow after the court sends him back to remand shooting down the bail and nd bond application from the suspect.

The indictment has restricted the release of killer cop Duncan Ndiema accused of shooting the 13-year-old Yassin Juma in Nairobi’s Huruma estate in March.

A official from the Independent Policing Oversight Authority (IPOA), Benedict Otieno, contends that Juma deceived the court that he went to Mbagathi Hospital after demonstrating indications of COVID-19.

Ndiema was on Tuesday accused of murder of 13-year-old Yassin Moyo. Showing up under the watchful eye of High Court Judge Luka Kimaru, he argued not liable and was remanded at Capitol Hill Police Station pending  his bail application.

The High Court had before conceded his request taking after his legal advisor said that the official had been admitted to the Mbagathi Hospital over the outcomes of a coronavirus test.

Notwithstanding, on Wednesday the examining official told the court that the denounced never visited the said hospital and was in Uthiru and Ndumbuini area, 15 kilometers from the said medical clinic.

“I as the investigating officer having received the orders from the court proceeded to Mbagathi and received information from the management of the hospital that they had not treated the accused that day as alleged,” reads the application.

IPOA says such direct and giving tricking data to the court is a characteristic of his hesitance to hold fast to court mechanisms and ought to be a consider taken denying him bail and bond.

IPOA contends that Yassin’s family had threats from people suspected to be the proxies and intermediaries of the blamed consequently there is a probability for him scaring the witnesses and cause obstruction.

“If the blamed individual is discharged on bail his discharge will upset an open request or sabotage open harmony or security and along these lines pre-preliminary confinement will be important to safeguard open application,” says IPOA.
