In order to submit to any demands for the processing of their land titles by their land registrar, legitimate land owners or buyers in Kwale County must go through a laborious and well-planned blackmail process.
Through this scheme, he has acquired a significant amount of property, including Mvindeni Ukunda, where he is currently building apartments and awaiting the signing of green cards.
In most cases, the office led by Mokaya has outrageously demanded a portion of the land be processed.
This has been the case for years until recently, when a number of landowners started involving investigative agencies to intervene in pursuit of their land documents.
The Kwale/Diani S.S. parcel of land is a case in point where the officer has taken three family members through endless circles with the intention, according to our investigations, of making them vulnerable and obedient to his demands.
A letter dated August 1, 2024, to the County Land Registrar, copied to the Ethics and Anti-Corruption Commission, and the Ministry of Lands details the frustrations the family has been through in pursuit of the land title despite having met all legal demands.
According to the letter, Mokaya issued a title deed for the property on July 3, 2024, after requiring the legally registered owner to personally appear before him.
This is despite a court order that vested the three family members with ownership of the property upon verification by Mokaya himself.
As a result, he had all of a sudden forgotten the real owners and had embarked on mind games.
They visited him in his office, but they didn’t receive the title deed until after 5 p.m.
Despite their presence in the morning, Mokaya ignored them until the evening. They had signed the title and were waiting for the owners.
Subsequently, they received unsuccessful applications for property searches, informing the applicants that the lack of a signed green card prevented the issuance of official search certificates.
They visited the land registry to enquire about the same on July 2, 2024, and met him briefly outside the land registry, where he confirmed the parcel file for the land.
Despite entering their entries on the green card and the serial number for the title deed, he intentionally refused to sign the green card, and according to the aggrieved owners, Mokaya is illegally demanding to be allocated a portion of the land.
According to sources, investigations show that other land officers and brokers in Kwale have assisted him in his schemes, which have fooled a number of gullible landowners.
He has acquired a lot of property through this scheme, and a notable example is Mvindeni Ukunda, where he is building apartments.
